The requirements of 17 USC 110 (1), the face to face teaching exception, are more clear-cut.  This statute allows for performance and display of works in their entirety if the activities happen under the following conditions:

  • In a classroom or similar place devoted to instruction

  • During face to face teaching

  • At a nonprofit educational institution

  • Using a legally made copy

For example, this is the exception that allows teachers to show an entire movie to a class, or play a CD, or project the pages of a picture book.  

This exception only applies to works that are performed or displayed, so it does not apply to photocopying someone else's textual material and handing it out to a class.  A teacher who does this without seeking permission from the rights holder should do a fair use analysis.
